GDPR / Schrems II Technology: Can Data Protection Compliance Cost Centers be Turned Into Lawful Data Use Profit Centers?

Schrems II Lawful Data Use

Schrems II Lawful Data Use

BRUSSELS, BELGIUM, April 1, 2021 / — Five data and privacy experts have urged businesses to anticipate upcoming trends in U.S. data privacy laws if they want to effectively future-proof their organisations. In response to the latest developments around the Schrems II ruling and evolving regulatory challenges for international businesses, spokespeople from leading firms in the sector have discussed an array of key trends including the potential for data protection compliance centers to become lawful data use profit centers by leveraging new technical controls required for Schrems II compliance.

A recent webinar hosted by regulatory intelligence provider, Vixio, brought forward discussions on whether GDPR compliance requirements (as highlighted in Schrems II) for technical controls required for protecting data when in use, can provide a foundation for the various state privacy and consumer rights laws being adopted across the U.S. Additionally, panelists discussed the possibility of data protection compliance centers being transformed into revenue-generating lawful data use profit centres by adopting the necessary technology controls needed to satisfy Schrems II.
In the webinar, five key points were highlighted by the industry leaders:

1. Global Locations Do Not Determine Data Obligations
Sylwester Frazzoni, Editorial Director, Vixio Regulatory Intelligence, highlighted that international obligations transcend where companies are headquartered. Evolving U.S. state laws require European companies to comply if they process specified thresholds of data covered by the laws, regardless of where they are located. Laws like the California Consumer Privacy Act (CCPA) and the new Virginia Consumer Data Protection Act ("VCDPA") require European companies to comply with disparate requirements regardless of where the companies are physically located.

2. More U.S. State Privacy Laws Are Expected in 2021
Nora Gebhardt, Journalist at Vixio Regulatory Intelligence, pointed out that state lawmakers need to send a clear message that they intend to establish consumer data protection rights. She also highlighted that 2021 may well see state privacy laws passed in Washington and Oklahoma, with other states evaluating privacy laws.

3. New Technical Controls Enable Lawful Global Data Objectives
Gary LaFever, CEO & General Counsel at Anonos, Lawful Borderless Data experts, emphasized ( that investments in GDPR compliance could help European companies address compliance with non-EU data protection laws, such as U.S. state privacy laws and other data protection laws that come into force around the globe.
Furthermore, GDPR requirements as highlighted in Schrems II, can protect data when in use to help ensure predictability of operations and ongoing benefits from advanced secondary processing leveraging technology such as cloud-based Analytics and Artificial Intelligence (AI). Gary also highlighted that the technology controls required for enforcing GDPR requirements can turn data protection compliance cost centres into revenue-generating lawful data use profit centres.

4. The Virginia Privacy Law is More GDPR-Like Than California Law
Glenn Brown, Of Counsel at Squire Patton Boggs (, noted the key differences between the recent Virginia Privacy Law and the California Privacy Laws, including how companies under the Virginia Law can benefit from a 30 day cure period which does not exist under the California Laws. He also highlighted the trend of privacy regulatory laws becoming more GDPR-like and the importance of overarching data governance and data management in enabling companies to remain compliant under different U.S. state laws.

5. Digital Obligations Without Boundaries/Privacy is a Brand Value
Jill Reber, General Manager, Data Privacy at Logic 20/20 (, pointed out that digital data has no geographical limitations, and data privacy regulations are not limited to consumers and clients. Consumers pay attention to how companies are using their data and re-evaluating their relationship with the businesses that fail to use it responsibly. Privacy is a brand value that is dependent on trust, and trust itself is increasingly about data handling practices. Therefore, businesses that are thinking about their brand trust in this way will have a competitive advantage over those who do not.

Front Line COVID-19 Critical Care Alliance Statement on Weak Guidance on Ivermectin from the World Health Organization

The Front Line COVID-19 Critical Care Alliance Logo

The Front Line COVID-19 Critical Care Alliance

WHO ignores significant data, including several large clinical trials, while claiming insufficient evidence to recommend ivermectin to prevent & treat COVID-19

WASHINGTON, DC, UNITED STATES, April 1, 2021 / — The Front Line COVID-19 Critical Care Alliance (FLCCC), a group of highly published, world-renowned critical care physicians and scholars, is disappointed by what appears to be a deliberate omission of data by the World Health Organization (WHO) in arriving at its decision to not recommend ivermectin to prevent and treat COVID-19. The latest guidance from WHO ignores several large clinical trials where ivermectin was proven to prevent mortality by more than 68%. If the WHO guidance is followed, it will result in a further deprivation of a lifesaving drug and will only prolong the pandemic as it will continue to threaten the health of the global population.

The latest guidance from the WHO is out of alignment with many national and local health authorities around the world where ivermectin has been proven to prevent and treat COVID-19. These countries include, Bulgaria, Slovakia, India, Egypt, Peru, Zimbabwe, and Bolivia, and in several regions a growing number of health authorities have advocated for, or adopted ivermectin across Japan, Mexico, Brazil, Argentina, and South Africa and it is now the standard of care in Mexico City.

“I am deeply troubled that the WHO made this hasty decision on guidance before reviewing all available data,” said Pierre Kory, MD, MPH, president and chief medical officer of the FLCCC. “Their recommendation ignores the evidence, creates more controversy, and will only lead to continuing suffering and death from COVID-19. There are now over 24 randomized trials results that have been reported to the Unitaid/WHO team yet todays guidance was inexcusably based on a faulty analysis of just 16 of the available trials. Further, these erroneous findings directly conflict with numerous other peer-reviewed expert analyses that have found the data overwhelmingly demonstrates that ivermectin saves lives from COVID-19. There is no reason not to recommend it for everyone as a safe drug for prevention and treatment.”

The recent results of a comprehensive assessment of existing ivermectin trials demonstrated that it reduces the risks of transmission of COVID-19 by more than 90%. The Technical Working Group of the British Ivermectin Recommendation Development (BIRD) group presented the results to their Recommendation Development Panel and the presentation laid out the detailed results of a systematic review and meta-analysis of 21 randomized controlled trials (RCTs) of ivermectin on over 2,500 patients.

“To ignore the data the way the WHO has, does a disservice to science and to public health. It is time that as physicians we trust our own knowledge on how best to treat our patients.” said Pierre Kory, MD, MPH, president and chief medical officer of the FLCCC. “Allowing large, conflicted bureaucracies to do the thinking for us will only lead to continued and unnecessary suffering from the pandemic.”

About the Front Line COVID-19 Critical Care Alliance
The FLCCC Alliance was organized in March 2020 by a group of highly published, world renowned Critical Care physician/scholars – with the academic support of allied physicians from around the world – to research and develop lifesaving protocols for the prevention and treatment of COVID-19 in all stages of illness. Their MATH+ Hospital Treatment Protocol, introduced in March 2020, has saved thousands of patients who were critically ill with COVID-19. Now, the FLCCC’s new I-Mask+ Prophylaxis and Early At-Home Outpatient Treatment Protocol with Ivermectin has been released – and is a potential solution to the global pandemic.

Free “Truth About Drugs” resources help combat the upsurge of drug abuse during the pandemic

Free booklet on synthetic drugs with information anyone working with children or teenagers should know.

Drug-Free World materials on display including the Truth about Synthetic Drugs.

This free on-line course on synthetic drugs can be done in an hour. It gives information and tools to help to ensure youth are aware of the dangers of synthetic drugs. Studies show that increased awareness of the dangers of specific drugs leads to a reduction in use.

An alarming upsurge in drug use is being fought by local groups with drug prevention by educating youth

Synthetic drugs are some of the most harmful illicit drugs but they are often falsely advertised as ‘safe,’ ’natural’ or ‘legal’. What they really are is deadly.”

— Thalia Ghiglia, faith liaison Drug-Free World, Washington, DC

WASHINGTON, DISTRICT OF COLUMBIA, UNITED STATES, April 1, 2021 / — The pandemic has taken an unprecedented toll on many different strata in our society, from the most vulnerable to the well-to-do. According to the Centers for Disease Control and Prevention, as of June 2020 “13% of Americans started or increased substance use as a way of coping with stress or emotions related to Covid-19.” An American Medical Association report of December 2020 disclosed that 40 states had record deaths from overdoses.

Synthetic drugs include “bath salts” and synthetic marijuana (K2/Spice). Bath salts and other similar products are herbal mixtures that act as amphetamine-like stimulants that can produce euphoria, paranoia, agitation, hallucinations and even psychosis and violent behavior. Spice (synthetic cannabinoids) refers to a wide variety of herbs and chemical additives that produce a marijuana-like effect but may also result in even stronger reactions. A common misconception is that synthetic drugs are safer than other types of drugs, whereas they are actually much more dangerous.

In Minnesota, for example, the Department of Heath released drug overdose death statistics which showed a 31% increase in drug overdose deaths in 2020 compared to the same time period in 2019. Of these deaths, approximately 80% were synthetic opioid related deaths.

This year is difficult for many as physicians are tasked with handling Covid-19 as well as heart disease and other medical issues, leaving little time to help those who abuse drugs. The new practices of isolation, social distancing and lockdowns have broken down many of the social support systems, leaving some people adrift and unable to cope with this new reality. Many people turn to synthetic drugs thinking that these will solve and ease their mental problems, but by the time they find out that this is not the case, their lives have already been harmed or ruined.

To help educate people on the many dangers of synthetics drugs, a free booklet and a free online course are available from the Foundation for a Drug-Free World at

The Truth About Synthetic Drugs is a free booklet that explains why these drugs are some of the most destructive illicit drugs manufactured. It describes how synthetic drugs are created in laboratories abroad and imported into the US where they are put onto plant material that can be smoked or added to candies. The “manufacture” is unpredictable: one lot might contain a small amount of chemicals while other lots in the same batch might contain enough to overdose a person, causing severe medical issues or even death.

More information is in the Truth About Drugs Education Package, which contains practical tools to educate young people about substance abuse. This is available for free to teachers and educators. Parents and community members can download the free booklet and watch a short video on the truth about drugs.

Thalia Ghiglia, faith liaison for the Foundation for a Drug-Free World in Washington, DC, observed, “Synthetic drugs are some of the most harmful illicit drugs, but they are often falsely advertised as ‘safe,’ ’natural’ or ‘legal.’ They are definitely not legal and are not natural or safe. What they really are is deadly.”

The Foundation for a Drug-Free World is a nonprofit public benefit corporation that empowers youth and adults with factual information about drugs so they can make informed decisions and live drug free. The free booklets are used in thousands of schools and social programs to help youth with factual information about the drugs they may be offered.
